The following is a replica of a letter, dated November 19, 2015, from the State Department to then Representative Mike Pompeo, in response to Pompeo’s letter asking why the Iran agreement had no signatures. Italicized portions are mine:

Dear Mr. Pompeo:

Thank you for your September 18 letter regarding the nuclear deal with Iran.

The Joint Comprehensive Plan of Action (JCPOA) is not a treaty or an executive agreement, and is not a signed document. The JCPOA reflects political commitments between Iran, the P5+1 (the United States, the United Kingdom, France, Germany, Russia, China) and the European Union. As you know, the United States has a long-standing practice of addressing sensitive problems in negotiations that culminate in political commitments.

The success of the JCPOA will not depend on whether it is legally binding or signed, but rather on the extreme verification measures we have put in place, as well as Iran’s understanding that we have the capacity to re-impose – and ramp up – our sanctions if Iran does not meet its commitments.

Everything in the JCPOA and its annexes are commitments Iran has made, and must keep, to remain in compliance. If Iran breaks these commitments, we can snap back both unilateral and UN sanctions.

We provided Congress with everything agreed to between the P5+1 and Iran in the JCPOA, in full compliance with the Iran Nuclear Agreement Review Act (INARA). There are no “secret deals” between the P5+1 and Iran, and no JCPOA documents that Congress does not already have. The Administration is fully committed to proving information to Congress to ensure full transparency as we implement the JCPOA.

First, the JCPOA is not a treaty (it was never submitted to the Senate), it is not an executive agreement, and it is not signed. Therefore, the JCPOA is unenforceable.

Second, the Institute for Science and International Security, a Washington, D.C., arms-control think tank, revealed that Iran was secretly granted exemptions to the JCPOA so it could meet compliance requirements for what the agreement called “Implementation Day,” when Iran was to receive an estimated $150 billion in sanctions relief (https://www.nationalreview.com/2016/09/iran-nuclear-deal-secret-exemptions-prove-it-was-fraud/).

Third, regarding “extreme verification measures, the United States did not obtain on-site inspection rights and must rely on the International Atomic Energy Agency (IAEA), which has a troubled track record. In effect, there are no “extreme verification measures” (https://www.nationalreview.com/2015/08/iran-deal-weakens-verification/).

Fourth, since Congress did not approve the JCPOA, on whose authority did President Obama approve payment of $150 billion in cash to Iran? Only Congress can authorize such payment and it did not authorize such payment.

So what we have in the JCPOA is (1) criminal fraud perpetuated against the American people by the Obama administration, (2) an unenforceable, unsigned document that has no teeth, (3) “secret deals” attached to the JCPOA in spite of the State Department’s assertion to the contrary, and (4) an unauthorized gift of $150 billion to Iran in U.S. taxpayer dollars in violation of federal law.

Former Secretary of Defense and CIA Director Leon Panetta told FOX Business’ Maria Bartiromo that the implications of Iran resuming its enrichment program of uranium may draw the U.S. into a dramatic conflict in the Middle East.  In response, Iran said they will “restart” the nuclear program they never halted; they could restart enriching uranium in four days.

So much for Obama’s JCPOA: it was negotiated from weakness and it now shows how dangerous the JCPOA is to the world, in general, and the Middle East, in particular.

The result: more Obama lies, more Obama obfuscations, more investment in an enemy than any ally, and more Obama treachery against the American people. Will Obama ever be held accountable? No, because the system is rigged in favor of the so-called political elite and against the average American. Washington corruption is never-ending.
