Trump And Congress Are Seeking To Modify Birthright Citizenship

It is fashionable for many politicians to make campaign promises aimed at getting elected, and once elected ignore promises and engage in whatever policy they want to pursue. But Trump is not like most politicians. He has hit the ground running in pursuit of delivering what he promised on the campaign trail. He has done so by issuing a considerable number of executive orders, some of which are quite controversial.

None has been more controversial than the one Trump labeled, “Protecting The Meaning And Value Of American Citizenship”. This is the order dealing with birthright citizenship, issued January 20, 2025. It has been followed by legislative bills in both the Senate and the House aimed at implementing the president’s executive order.

Both the initial executive order and the subsequent congressional action have been grossly mischaracterized by Trump’s opponents and members of the mainstream media. To be clear, a reading of the original text reveals that neither action is aimed at doing away with birthright citizenship or amend the 14th Amendment. They are only intended to clarify the meaning of the phrase, “subject to the jurisdiction” which places a limit on who is eligible for birthright citizenship.

The executive order reads, in part:

“Sec. 2.  Policy.  (a)  It is the policy of the United States that no department or agency of the United States government shall issue documents recognizing United States citizenship, or accept documents issued by State, local, or other governments or authorities purporting to recognize United States citizenship, to persons:  (1) when that person’s mother was unlawfully present in the United States and the person’s father was not a United States citizen or lawful permanent resident at the time of said person’s birth, or (2) when that person’s mother’s presence in the United States was lawful but temporary, and the person’s father was not a United States citizen or lawful permanent resident at the time of said person’s birth.

(b)  Subsection (a) of this section shall apply only to persons who are born within the United States after 30 days from the date of this order.

(c)  Nothing in this order shall be construed to affect the entitlement of other individuals, including children of lawful permanent residents, to obtain documentation of their United States citizenship.”

The Senate bill, known as The Birthright Citizenship Act of 2025, was introduced by Senators Graham, Cruz, and Britt. It clearly states that the purpose of the bill is:

“To amend section 301 of the Immigration and Nationality Act to clarify those classes of individuals born in the United States who are nationals and citizens of the United States at birth.”

A similar bill has been introduced in the House by Representative Brian Babin.

Worldwide, birthright citizenship may not be as widespread as one may think. Of the 195 recognized countries, only 75 have birthright citizenship, according to World Population Review. Their recent study shows that of those 75 countries, roughly half practice unrestricted birthright citizenship, while the rest have some sort of restriction. It seems that the United States would be in sync with the rest of the world if a common-sense tweaking, like the one Trump is proposing were applied here. The full report may be accessed HERE

  1. gotta remember the the left/democraps always look to hurt the country not make it better. They fear the potential loss of future voters with this legislation. They lie continuously and the indoctrinated citizens have no idea of what is in the law/constitution. If here when there is a birth and neither party are citizens then the baby will be o0f origin of the country the parents are from. Time to fix it.
