“Tough Titties” Teacher License At Risk

During the 2013-2014 school year, Bryan Brothers was employed as a teacher at Centennial Middle School in the Kyrene Elementary School District (“KESD”) located in Phoenix, Arizona. He holds a Provisional Secondary Education 7-12 certificate, which expires on June 11, 2016.

On or about March 14, 2014, Mr. Brothers made the comment “tough titties” to at least some of the players on the Centennial Junior Varsity girls’ basketball team. On March 17, 2014, Centennial Principal Jocelyn Sims had a verbal discussion with Mr. Brothers about appropriate conduct.

On May 16, 2014, Respondent wrote the following comment near the fold of an 8th grade female student’s yearbook: “There is a penis in your crack LOL”. Mr. Brothers also drew a picture of a penis next to that comment.

On May 16, 2014, KESD Superintendent Dr. David Schauer reassigned Mr. Brothers to home pending investigation into the alleged conduct.

On June 10, 2014, the KESD Governing Board voted to dismiss Mr. Brothers from employment with KESD.

On or about June 26, 2014, Mr. Brothers submitted a letter of resignation to KESD.

On July 2, 2014, the KESD Governing Board approved Mr. Brother’s resignation effective immediately.

On or about January 19, 2016, the Board Investigative Unit and Mr. Brothers’ counsel entered into negotiations regarding a settlement agreement. He agreed to the terms of the proposed settlement agreement.

The Negotiated Settlement Agreement consists of a one-year suspension of any and all
certificates, with the following conditions:

• Participate in, and successfully complete, a course or seminar which addresses boundary issues. Any such course or seminar must first be approved by the Board staff.

• Provide a letter of proof of successful completion to the Board certifying completion of the course or seminar addressing the issues that led to the conduct described above.

It is recommended that the State Board of Education accept the Negotiated Settlement Agreement, with conditions and suspend any and all certificates held by Brandon Brothers for one year from today’s date, with the above listed conditions, and that all states and territories be so notified.

Superintendent Diane Douglas had the case pulled from the Consent Agenda, and the Board rejected the Negotiated Settlement Agreement. The Board didn’t take his license/certification for a one-year suspension. The agreement was rejected, so, now it has to go to the Professional Practices Advisory Committee and back to the board for the full process, or he can voluntarily surrender the certificate.

    Comes to mind an old saying: “…convinced against the will remains unconvinced still”.But who are we to question the collective wisdom of all those Phd’s? The B of E is lacking and in need of a street savvy member wise to the ways of the snakes in the grass.

    If Mr Brothers had written about a penis in my 8th grade daughter’s year book, he would have been wearing the yearbook up his arse. The guy is obviously a pervert and needs help. In no way whatsoever should he be allowed to be around children. Ever. Again.

    Rejection of the Negotiated Settlement Agreement ensures that Bryan Brothers’ completely unacceptable actions will not be punished with a mere ONE-YEAR slap on the wrist!

    I hope will voluntarily surrender his certificate, with prejudice against him ever again being allowed in an Arizona Classroom!

    It would save the people of Arizona the further costs that will otherwise accrue if we have to follow the process for revoking it forever!

    But, if he doesn’t surrender his certificate, revocation is the only proper resolution of this matter!

    I was a student in his 1st hour. First off, his name is Brandon. Second he wasn’t a pervert being a typical fresh out of college computer nerd/gamer. Up until that day during the last week of school, brothers was the one teacher I looked forward to seeing especially after he helped me with my suicidal thoughts and depression. Sure what he wrote was highly unprofessional at his age, it didn’t make him a bad teacher.

    It didn’t make him a good teacher either. maybe he should try welding or another vocation. Get professional help for your depression. It will help. God bless you.
