Supplier’s Lawsuit Hopes To Put Bite On Sierra Vista Dental Office

A Sierra Vista area dentistry office is being sued in Cochise County Superior Court by a Massachusetts-based dental supply company for more than $42,000 in purportedly unpaid invoices, some of which date back to July 2018.

The May 28 lawsuit alleges Advanced Dentistry PLLC owes $42,711 plus interest to Straumann USA, a leading supplier of dental implant products and surgical instruments for several invoices dated in 2018 and 2019. Advanced Dentistry provides a variety of services from its office on Canyon De Flores Drive, including oral surgery, orthodontics, and cosmetic dentistry.

Straumann’s lawsuit alleges unjust enrichment and breach of contract for goods sold and delivered, noting the supplier “sold certain goods to (Advanced Dentistry PLLC) with the express understanding that payment would be made by Defendant, pursuant to the terms of the parties’ agreement.”

The lawsuit seeks a judgment for the amount of unpaid invoices, attorneys fees, as well as interest “at the highest statutory rate allowed by law per annum.” Advanced Dentistry will have until early July to respond to Straumann’s claims.

Court records also note that the dispute could be subject to compulsory arbitration.

According to Advanced Dentistry’s website, the company was named as “Best of Sierra Vista” in Patient Satisfaction for 2018 by Dental Insider, an industry directory. The office appears to operate with one dentist -Kent Hales- and several support professionals.
