House Passes Civil Liability Bill Along Party Lines

On Monday, the Arizona House approved a civil liability bill, SB1377, that allows businesses to avoid frivolous COVID-related lawsuits.

In a party line vote, the House narrowly approved Sen. Vince Leach’s bill which is opposed by trial lawyers.

The bill mandates that, for civil suits resulting from damages during a pandemic related state of emergency, the burden of proof is elevated from the customary preponderance of evidence, to clear and convincing evidence.

Because it was amended in the House, it now returns to the Senate for a final vote.
