A Sierra Vista man arrested last week on a statewide warrant issued in connection to a February sexual assault is scheduled to be arraigned Monday at the Cochise County Superior Court.

Brian T. Wells was taken into custody last week and booked into the Cochise County jail where he remains in lieu of $100,000 bail. He is charged with two felonies – committing sexual assault against a former girlfriend on Feb. 6 and kidnap stemming from the woman’s report that she had also been restrained by Wells during the assault.

Public records show Wells, 48, was with a Sierra Vista police officer filing a domestic violence complaint against his ex-girlfriend at the same time she was at the Sierra Vista Police Department reporting a sexual assault. DNA evidence sent to the state crime lab came back with a “hit” to a record purportedly belonging to Wells, so investigators obtained a search warrant to secure a current DNA sample for a confirmation test.

With the confirmation result in hand, the Cochise County Attorney’s Office submitted a two-count criminal complaint against Wells on May 3. A Cochise County grand jury later indicted Wells on the same charges, which are both Class 2 felonies. An arrest warrant was issued in the case, but Wells had to be located.

A SVPD detective learned of Wells’ location on June 17 and the arrest was made. Wells will be represented at Monday’s arraignment by a court-appointed attorney.

No charges were filed against the woman in response to Wells’ complaint.
