… some interesting exchanges between Senate attorney Kory Langhofer, Boyer and Fann following the failed Senate vote to hold the Maricopa County Board of Supervisors in contempt for not complying with legislative subpoenas for election materials. Fann, in an email to Republican senators and staff, said it appeared the supervisors and their attorneys were “less than honest” about their intention to cooperate and were looking to delay the process in order to “avoid a forensic audit being done.” Fann’s email was part of a thread discussing a letter from the supervisors’ attorney concerning a lawsuit against the Senate challenging the subpoenas. (A superior court judge later found the subpoenas enforceable, and the board decided not to appeal.)

“(I)t appears they purposely misled Senator Boyer about wanting to cooperate to make sure the Resolution was defeated,” Fann wrote. “… I hope Senator Boyer can see that he was being used and will change his mind about letting the senate proceed with enforcing the subpoenas.” Boyer replied all. “Please feel free to speak to me directly instead of in the third person,” he wrote. “I am more concerned about being versus seeming.” He said he was aware of the letter and that there was distrust on both sides.

“I am tracking down several things regarding this very important and timely issue,” Boyer wrote. The next day, Boyer asked Langhofer if the Senate had filed its response to the county’s complaint. Langhofer said it didn’t seem like the question was coming only from him. “I hope you don’t mind me observing that this question appears to have been provided to you by someone else,” Langhofer wrote. “I hope the person who provided the question informed you that their Amended Complaint was filed after hours last night, so it wouldn’t be reasonable to expect an Answer to have been drafted, approved and filed already.” Boyer responded, “Thank you Kory for your observations and your response….”
