Phoenix police have made an arrest in connection with an aggravated assault of 16-year-old Wendy’s employee, Brian Durham, on January 13, 2022. The suspect is identified as Theotis Polk, age 27.

According to the Phoenix Police Department, officers were called to the fast-food restaurant in the area of 19th Avenue and Glendale Avenue. When they arrived on the scene, they found the teen suffering from a gunshot wound to the head.

Police say that information gathered at the scene indicates one of the employees was involved in a verbal argument with a customer over an order at the drive-thru window of the business. The customer reportedly walked up to the drive-thru window, pulled out a handgun and fired into the drive-thru window hitting the teen working inside the store. The suspect jumped in the passenger side of a vehicle which then fled the scene.

The young man is “now stable after having surgery,” according to ABC15.

The investigation is ongoing.
