Arizona Legislators Celebrate SCOTUS Decision Allowing Texas Police to Arrest Illegal Aliens

Arizona state legislators are hailing a decision by the U.S. Supreme Court allowing a recently enacted Texas law to remain in effect, that permit local police to arrest and detain illegal immigrants.

Representative Steve Montenegro, one of the legislature’s more conservative members, and a longtime leader in the fight against illegal immigration, called the decision a “significant victory for the rule of law.”

Montenegro, who is himself a naturalized citizen, commended the Court’s action and views Texas’ law as an example for states like Arizona which are striving to reclaim control over their borders amidst deliberate federal inaction by the Biden administration.

Montenegro is the sponsor of HB 2821, which is largely modeled after the Texas law. Democrat Governor Hobbs recently vetoed the Senate version of this bill, SB 1231, sponsored by Senator Janae Shamp, on an unfounded claim it would be “unconstitutional,” an assessment Montenegro says has been clearly contradicted by the Court’s decision.

“The federal government’s deliberate refusal to secure the border has left states like Arizona defenseless against the surging crisis of illegal immigration fueling rampant drug and human smuggling,” said Montenegro. “Today’s decision by the U.S. Supreme Court is a clear and significant victory for the rule of law, and it inspires hope for us in Arizona who firmly seek to uphold our sovereignty and protect our citizens. I am evaluating legislative options so that the Arizona Legislature can offer Governor Hobbs another opportunity to do the right thing for Arizona.”

Senate Republicans are also celebrating the decision and demanding Governor Katie Hobbs fulfill the obligations of her sworn office by approving legislation mirrored after Texas’ S.B. 4, so that local, county, and state law enforcement within Arizona have the same tools to protect Arizona citizens from criminal activity.

“The Arizona Governor has vetoed legislation that would have given Arizona’s law enforcement the ability to protect our citizens from the invasion occurring at the southern border. The U.S. Supreme Court’s decision to allow Texas’ S.B.4 to go into effect shows that the Governor’s veto was rash and hasty.” said Senate President Warren Petersen. “She will soon have the opportunity to do the right thing, as we will give her another chance to sign this bill into law to protect Arizonans from border-related crimes.”

“While Joe Biden continues to neglect the national security crisis of this border invasion that’s allowing deadly fentanyl, terrorists, human smugglers, child sex traffickers, rapists, murderers, and other dangerous criminals to forever change our communities and the lives of Arizonans, state legislatures across the country are rightfully overriding the failures of his administration and Arizona is no different,” said Shamp. “We are urging Hobbs to not fail Arizonans again, and to sign our legislation when it hits her desk.”

  1. Just arresting them does nothing; dump them as far away as possible and make it difficult for them to come back. Sic Buyudung’s dogs on them; they’ll bite anything. I still like the idea of alligators in the Rio Grande.
