
Arizona Attorney General Kris Mayes, along with attorneys general in Illinois, Oregon and Washington, are filing a lawsuit against the Trump administration in the United States District Court for the Western District of Washington over the president’s birthright citizenship Executive Order.
“As I said after the election, I will not allow Donald Trump to shred the United States constitution,” Mayes said at a news conference on Tuesday afternoon, arguing that the action violates the 14th Amendment.
“This executive order has nothing to do with national security or protecting American jobs,” she continued.
In total, 22 states are suing in various cases as it relates to the order, according to ABC News. Mayes said in her case they are first looking to get a temporary restraining order and then a preliminary injunction.
Mayes said that while it will not go into effect for another month, she believes “the chaos from this is going to be immediate.”
Trump called birthright citizenship “ridiculous” while signing the Executive Order on Monday, shortly after being sworn-in for his second non-consecutive term.
The order is meant to specifically crack down on the future children of those who are residing in the United States illegally.
“We have very good grounds. People have wanted to do this for decades,” he said.
The president signed a wide variety of immigration related orders on Monday, including dubbing drug cartels as terrorist groups, scrapping the “CBP One” app and bringing back border wall construction efforts. Arizona’s border communities will likely be at the forefront of many of these changes.

The Constitution says what it says. It’s right there in plain English for all literate people to read. That Mayes, Bonta (AGCA), and a score of other Blue State AGs have elected NOT to ignore the Constitution _in this case_ is irrelevant. If “shall not be infringed” is crystal clear, then so is, “All persons born or naturalized in the United States”.
Let’s all have a little consistency when saying we shall venerate, honor, and defend the Constitution.

as I read the amendment it says the right is for those who are under the consent of the people/government to be here. Illegals do not meet this criteria therefore since they have no constitutional rights they should not be given citizenship.
I beg your pardon, but that is not what it says. It says, “… and subject to the jurisdiction thereof …”. The only people without our borders not subject to our laws are foreign government diplomats (“dipolmatic immunity”). Ergo, for better or worse, the children of illegals, born here, are immediately citizens of the U.S.
If “shall not be infringed” means what it says, then, “All persons born or naturalized in the United States” means what it says. If we want to get loosey-goosey with words, that’s a game The Left loves to play, and they are well practiced at it.

I don’t know why the phrase “and subject to the jurisdiction thereof” is left out of the discussion of Section 1 of the 14th amendment. It clearly lays out the parameters for being a citizen, and not covering the example of crossing the border as an illegal alien and having a kid on U.S. soil.
The only ppl within our borders not subject to our laws, i.e. for which they can be charged, prosecuted, and jailed, are diplomats. Otherwise, everyone else fall under that phrase. Are you sure that’s a can of worms you want to open?
Isn’t Mayes Arizona’s chief law enforcement officer. Her actions are shameful, and bring discredit upon her and unwanted attention upon the incompetence of Mayes’ chief executive, who obtained the position by fraud. What an embarrassing duo.
The majority of AZ voters just elected Trump and approved the policies he advocated. How Mayes dare to challenge the majority of AZ voters’ will? Who does she represent? Saying that she defends the Constitution is a farce, she is defying the will of the majority.
In addition, Ds always said that immigration is a federal issue and states should not get involved. So stick to that position now. Let the federal level figure this out. Mays is a Democrat and should not be a hypocrite.

Brother, seriously. Joe won the popular vote last election. Are you saying the State AGs _had_ to go along with his madness? Or do they, perhaps, have a legal, moral, and civic duty to challenge what they see as unlawful orders? I think she’s dead wrong on most things (not this one, and maybe not for the right reason even), but I also believe the AG has the right and obligation to challenge any politician at any level of government that she feels threatens Arizonans.

Let’s give Trump credit for doing what he says he will, but I think this one’s a stretch, particularly for an executive order. Any consideration of eliminating birthright citizenship should be part of an overhaul of our immigration system, with all the parameters considered including what Bill’s situation is.
What are you talking about??? Our immigration system does not need an “overhaul”. All President Trump needs to do is to strictly enforce present immigration law. The concept of altering present immigration law has been the goal of the Democrat Party for years!

Agreed, except that as a Constitutional amendment, birthright citizenship supersedes any and all legislation and executive diktats. If The People truly want that changed, the instruction are in Article V of the same document.

And, thanks to Ted Kennedy’s chain migration, every one can “sponsor” as many new encroachers as they please. (According to the government, there were almost 400,000 births to illegals in 2024.)

May I suggest that you go back and reread the part of the First Amendment that has to do with the ability of the people ‘peaceably to assemble, and to petition the Government for a redress of grievances’, and apply that to your prosecution of Arizona’s 2020 alternate electors. And while you’re at it, do some research on why the 14th Amendment was written in the first place. It wasn’t written to bestow birthright citizenship on people who are here from another country, either legally or otherwise.

the ambulance ride to citizenship… having worked in an ER along the border – and being part of the delivery team – or sometimes alone – depending on how many how fast! It was not uncommon – well known practice – that the ‘mom’ would be transported to the USA side for ’emergent care’ – giving birth.. so that the baby would have ‘automatic citizenship’ – also providing a path for mom.
My mom – was Mexican at time of ‘my birth’ She became American when I was 8. She was married to an American – but in Mexico 🙂 I was born here 🙂 (St.M) So am I an American under the TRUMP law ? Better hurry up with that decision – I”m not getting any younger. Grandma was a ‘green card’ for her life. This living on the border.. loco at times
