Republicans File Appeal Against Secretary Of State’s Election Procedures Manual

On Tuesday, the Republican National Committee, the Arizona GOP, and the Yavapai County Republican Party filed an appeal challenging the legality of the 2023 Elections Procedures Manual (EPM) issued by Arizona Secretary of State Adrian Fontes.

The appeal, currently before the Arizona Court of Appeals, argues that the 2023 EPM was promulgated and implemented without proper public input, violating Arizona’s statutory requirements. The manual includes rules that directly conflict with state law, threatening the integrity of the upcoming 2024 general election.

“Our lawsuit is about ensuring that every Arizonan can have confidence in the fairness and transparency of our elections,” said AZGOP Chair Gina Swoboda. “The rushed and secretive manner in which this EPM was implemented is unacceptable. We are committed to fighting for the rule of law and the rights of Arizona voters.”

The Republican Party is seeking an expedited briefing schedule to ensure that any necessary changes to the election procedures are made well before early ballots are mailed out for the 2024 general election.
