Scottsdale Attorney Suspended for Client Abandonment

Scottsdale attorney David K. Rosen has been suspended for two years after abandoning clients and continuing to practice law while serving an earlier suspension.

The Presiding Disciplinary Judge of the Arizona Supreme Court accepted an agreement for discipline by consent between Rosen and the State Bar of Arizona that resulted in the two-year suspension.

Rosen was hired to represent his client in a personal injury case after she fell at a casino on tribal land. He failed to inform his client that a hearing was continued before she traveled from New Mexico to Arizona. After the continuance, he failed to respond to opposing counsel’s request for discovery and a notice of default was entered. Rosen failed to appear at the dismissal hearing and the court dismissed the case.

In another matter, Rosen was hired to represent his client who was involved in a car accident. He failed to timely satisfy several medical liens and negotiated a settlement while serving a prior disciplinary suspension.

Rosen also failed to timely file a separate client’s products liability case which led to its dismissal. The client sued him for malpractice relying on his disclosure to the State Bar that he possessed professional liability insurance. Rosen, however, did not possess such insurance. He also failed to respond to the Bar’s investigation.

Rosen’s earlier six-month suspension was ordered to begin on September 19, 2016. He continued to represent clients after the effective date of this suspension.

David K. Rosen’s two year suspension will be effective 45 days from the date of the order issued on May 10, 2018. He was also ordered to pay $1,200 for the costs and expenses incurred by the State Bar of Arizona.
