Phoenix Father In Jail After Accidental Shooting

Phoenix Police detectives are investigating an accidental shooting that left a toddler in the hospital and the father in jail.

According to the Phoenix Police Department, on July 9, 2025, around 10:40 p.m., officers responded to a home in the area of 84th Avenue and Campbell Road regarding a toddler having been shot. When officers arrived, they found the toddler with a gunshot wound. The toddler was transported to a nearby hospital with non-life-threatening injuries.

Detectives learned that the toddler found the gun within the home and accidently shot himself. The family at the home was interviewed at which time it was learned that the father of the toddler, identified as 27-year-old Oscar Guerra, left the gun out and accessible to the victim prior to the accidental shooting.

Oscar was arrested and subsequently booked on one felony count of child abuse.

The Department of Child Safety was contacted and is conducting a separate investigation.

  1. It’s one thing if this guy is a stoner or a drunk and negligently shoots the child. That seems to me a prosecutable offense. This seems like an accident, one that could have been prevented for sure, but still an accident. There is no compelling interest for the state to intervene; good and feel good ideas often make for poor law with respect to individual liberty.

    We’re well into a downward spiral where there are no more accidents. Where living a bubble-wrapped existence is a ‘human right’, but the human fallibility is not. Freedom and safety are inversely proportional.
