Some Bills Ducey Vetoed Are Signed, Await Signature, Others Embedded In Budget

During the budget negotiations, Governor Ducey vetoed 22 bills without regard to their worth, in an apparent attempt to teach the legislature a lesson. He apparently was emboldened by the lack of legislative resistance to his arbitrary executive orders dealing with the COVID state of emergency.

The legislature’s response has been to re-introduce all 22 bills under new bill numbers, and under a suspension of the rules.

Most of these bills cleared both chambers and were sent to the governor for his action. Some have been signed and some are still pending.

Under current rules, the governor must act within ten days after Sine Die. If he does not, the bills sent to him will automatically become law.

Those voters who have an interest in the bills pending the governor’s action may wish to contact him and express their opinion. This may be accomplished by using the contact information at the end of this article. Here is a list of those 22 bills.

SB1834 marijuana; inspections; licensing; financial ownership. Allows the Arizona Department of Health Services (DHS) to perform unannounced inspections of a nonprofit medical marijuana dispensary (dispensary). Establishes a license renewal date for dual licensees. Signed by governor
SB1835 party representative; resident; violation. Stipulates that a challenger or party representative must be a resident of Arizona and registered to vote in this state and provides a penalty for impersonating such a person. Signed by governor
SB1836 sex offender registration; termination. Modifies sex offender registration termination requirements and permits additional offenders to apply for termination. Pending governor Action
SB1837 early ballots; request required. Specifies that a county recorder or other election officer may not deliver or mail an early ballot to a person who has not requested an early ballot for that election. Killed in the House

SB1838 unborn child; statutory language. Replaces references to product of human conception with unborn child. Signed by governor
SB1839 guilty except insane; court jurisdiction. Makes various changes to Arizona Psychiatric Security Review Board (PSRB) and adds additional statutory framework for the PSRB. Requires the Department of Law to review an executive order for its constitutionality and whether the state should seek an exemption, upon the request of the Legislature, either house of the Legislature or any member of the Legislature. SB1848 emergency shelter beds; seniors. Requires the Arizona Department of Housing (ADOH) to provide emergency shelter beds in western Maricopa County to shelter and service homeless seniors who are at least 55 years old. Pending governor Action
SB1849 prisoners; training; individual certificates. Allows a prisoner is to receive a certificate when the prisoner successfully completes a training program to work in a specific field or trade. Makes changes to health and medical services offered to female inmates. Pending governor Action
