Man Jailed In Cochise County Waives Extradition Challenge On Colorado Charges

A Colorado man awaiting trial in Cochise County for DUI and aggravated assault is heading back to his home state where he faces multiple charges stemming from a domestic violence incident earlier this year.

Marcus Xavier Galligan came into contact with Sierra Vista police officers on Aug. 9 after being involved in a vehicle accident. He did not have a valid driver’s license at the time and was suspected of driving under the influence of a dangerous drug, according to a Cochise County grand jury indictment.

The officers also learned Galligan, 35, was the subject of an outstanding warrant from Douglas County, Colorado. Court records obtained by Arizona Daily Independent show the 10 counts in Colorado include assault, felony menacing, false imprisonment, and violation of a protective order. That case is flagged as involving domestic violence, a District Court spokeswoman said.

Galligan attended an extradition hearing last week with Judge Timothy Dickerson at Cochise County Superior Court and consented to being held in jail until Colorado officials arrive to escort him back to Douglas County for a case status hearing. In the meantime, Galligan was formally arraigned on the DUI / assault case on Wednesday by Judge Jason Lindstrom.

The 7-count indictment in Cochise County alleged Galligan made “a false, fraudulent, or unfounded report or state, or knowingly misrepresented a fact” following the motor vehicle accident in Sierra Vista. He is also accused of putting four people -including two minors under age 15- at “apprehension of imminent physical injury- stemming from the accident.

Prosecutors in the two states must still decide which county will put Galligan on trial first.
