Strike-Everything Amendment to HB 2502 Overview

Modifies the requirements for incorporating a city or town or an urbanized area into a city or town.

History

A community must meet certain population and voter requirements when submitting a petition to incorporate as a city or town (Petition) to the Board of Supervisors (Board). A Petition must include the metes and bounds and name under which the petitioners desire to be incorporated. Two-thirds of the voters residing in the community must sign the petition. Prior to obtaining any signatures, the petitioners must file the Petition with the county recorder or county elections department (County).

The petitioners then have 180 days from the date of the County filing to obtain the required number of signatures. (A.R.S. § 9-101).

After submitting the Petition, the Board must call an election within 60 days and hold an election within 180 days. Only voters of the community may vote on the Petition. If a majority of the voters vote in favor of the Petition, the Board must declare the community incorporated as a city or town (A.R.S. § 9-101).
